Child Care Facility Abuse Real And Unacceptable

Day Care Injury & Abuse

Child abuse comes in many forms, none more disturbing than when the person or people you trust to keep your child safe are the ones committing the abuse. Abuse in daycare and other centers is a serious issue that must not go overlooked. It is your right to question daycare practices you feel are not in your child’s best interest no matter how small the issue may appear.

According to the Texas Department of Family and Protective Services (TDFPS), the first death of a child as a result of an adult caregiver at a daycare facility leaving the child in a hot car during the Texas summer, occurred on May 16, 2006. As shocking as this may be, the TDFPS keeps track of these “first dates” of death every year, suggesting an epidemic of unacceptable care of children that has become widespread in this state. Unfortunately, such deaths are now expected every summer as childcare facilities continue to offer unsafe and sub-par protection and care for our children.

While the regularity of infant and young child death due to negligence by daycare personnel is certainly among the most horrendous of stories concerning daycare facility abuses and neglect, they are hardly the only concern that parents should and do have regarding the facility that is entrusted to care for their children.

Just one instance of child abuse by a daycare worker is far too many. But the sobering truth is that children are regularly abused and/or exposed to dangerous neglectful actions while in the care of daycare facilities. Fortunately for parents looking for a trustworthy facility in which to entrust their child’s safety, the TDFPS documents and details each and every report of abuse, neglect, and state law violations that are reported and investigated by the agency. All of this information is available to the public.

We here at the Rasansky Law Firm currently represent a number of families that have suffered greatly as a result of abuses and neglect of child care facilities that result in injury to their children.

The attorneys at Rasansky Law Firm are deeply concerned with the regularity of abuses and neglectful harm suffered by children while in the care of child care services, and are dedicated to helping any parent and child that has suffered as a result to seek justice for such inexcusable actions. By holding those facilities and the individuals involved accountable, we hope to solicit wholesale changes in the hiring, supervision and governance standards of child care facilities.

Signs of Physical Abuse

Consider the possibility of physical abuse when the child:

  • Has unexplained burns, bites, bruises, broken bones, black eyes, cuts, or scrapes
  • Has fading bruises or other marks noticeable after an absence from school
  • Shies away from adults and physical contact
  • Reports an injury from a caregiver

If the caregiver, when confronted, gives conflicting, unconvincing or no explanation for the injury, describes the child as evil or otherwise in a negative fashion, or has a history of complaints, physical abuse may be occurring with your child. Parents should be cautioned to investigate the child care facility that is being considered to be, or is currently, entrusted with the care of their children. Futhermore, if any concerns arise about possible neglectful actions or abuse by anyone at that facility, parents should certainly report such concerns to the Texas Department of Family and Protective Services so that an investigation may be undertaken into the incident. Is your child suffering from physical abuse at daycare?
