What If An Uninsured Driver Hit Me?
Your medical insurance will cover your bills and then try to recover the money from the driver to cover the costs. In some states, insurance pools exist to compensate victims of uninsured drivers, so long as the driver's sentence in his case may include covering your medical expenses. It would be best to consult with your insurance provider.
Your attorney will be able to sue for damages, however, since he is uninsured, you will probably not be able to recover much as it is unlikely he has much in terms of assets.
You may also consider a "Dram Shop" action, which is where you bring a suit against the party responsible for serving the alcohol to the driver, resulting in his intoxication. If the driver was at a bar and he was served after he was intoxicated, the bar COULD be liable for your injuries. Not all states allow Dram Shop actions, so be sure to discuss it with your attorney.
Dram Shop cases are difficult to handle, because you have prove the driver's attendance at the bar and whether he was served AFTER he was intoxicated. However, if the proof is there, you should seriously consider this alternative.
