Drunk Driving Accidents in Texas

Alcohol-Related Auto Accidents

Drinking and driving do not mix. Unfortunately, in the Unites States, someone dies every thirty minutes because of a drunken driver. Statistics show drunk driving accidents are responsible for an incredible number of traffic deaths in the United States each year.

It's obvious that when a drunk driver causes an accident, they acted negligently and should be responsible for the damages to the innocent victims. Those who provided the alcohol may in some situations also be considered negligent as well under Texas' dram shop laws.

State Laws on Liability of a Bar or Alcohol provider

Many states, including Texas, have laws which impose liability restaurants, bars, clubs, and hotels which serve liquor improperly. In Texas, an alcohol provider can serve a person up to the point of intoxication, but must not serve an already-intoxicated (and obviously intoxicated) customer.

While many people struggle to understand these liquor liability laws, the bottom line is that bars, clubs and restaurants must follow certain rules laid out by the TABC in order to maintain their license to sell alcohol. Selling alcohol is a privelage and not a right. The more drinks you sell, the more money you make. But when a bar over-serves a patron to the point in which they are now a danger to themselves and the community, they are putting profit over the wellbeing of the public. This is why several states have enacted what are referred to as dram shop laws.

Drunk Driving and Impaired Judgment

Impaired judgment is a common effect of drinking. When a driver gets behind the wheel drunk, their judgment is severely impaired. Drunk drivers often speed excessively, make improper turns, fail to stop at red lights or stop signs, and drive on the wrong side of the street or highway.

Criminal Charges for Drunk Driving

DWI accidents in Texas could result in criminal charges against the drunk driver, such as negligent homicide or negligent injury, intoxication manslaughter, or intoxication assault among other charges.
