Three Things to Look for in a Car Wreck Attorney

Submitted by jrlaw on Dec 27th, 2011

If you're involved in a car wreck that was caused by another driver's negligence, hiring an attorney is one of the options you have available to you. An attorney may be able to help you get a lawsuit together that could end up winning you compensation from a jury. Before you go out and hire an attorney, consider whether or not they meet the three following criteria, which should let you know whether or not they are a good choice.

Truck Wrecks and Negligent Drivers

Submitted by jrlaw on Oct 28th, 2011

There are plenty of ways that truck wrecks can occur. Some of the most deadly wrecks, however, are caused by negligent drivers that don’t live up to the requirements of a professional trucker. In some cases, the companies that these truckers work for are negligent and fail to provide the right equipment or to maintain their equipment properly. Either situation can cause deadly accidents. If you're involved in a wreck involving a commercial vehicle and want to explore your options, you need to contact a lawyer.

The Accidents

The most distressing aspect of accidents involving trucks is the fact that they can result in deadly and devastating injuries for the people involved in them. Anyone in a car or pickup doesn't really stand much of a chance against a truck. Any angle of impact and any speed are going to be potentially lethal to the driver of the smaller vehicle.

Liability

There are very specific requirements for any commercial driving firm. If they fail to maintain their vehicles as required, they may be found negligent. If they don't provide good working conditions for their drivers, they may also be liable for being held negligent. Drivers are required to have a certain amount of rest when they go on long road trips. If the drivers aren't being afforded this time to recharge, the company that they work for may be held liable if an injury results.

What is Driver Negligence?

Submitted by jrlaw on Sep 16th, 2011

Whenever you get behind the wheel, you are accepting a certain level of responsibility for the other drivers with whom you share the road. This is the foundation of the law that allows people to sue when other drivers are negligent. When those negligent drivers cause bodily harm, property damage and pain and suffering to other drivers, they sometimes find themselves facing down a lawsuit. Understanding negligence will help you to understand whether or not you have been the victim of it.

How Does it Work?

Negligence has to do with what a person can be reasonably expected to do. This means, for example, that nobody is expected to be able to drive their vehicle at the level of skill characteristic of a professional racecar driver. You are only expected to drive at the skill level that would be reasonable to anticipate in someone who is qualified to have a regular driver's license.
To give an example based in a scenario, you really couldn't hold someone liable for negligence if they fail to react like a professional driver in order to avoid a common rear end accident. On the other hand, if the driver happens to cause a wreck that anybody should have been able to avoid, that driver may be held liable for negligence.

All Jammed Up : Driving in Heavy Traffic

Submitted by jrlaw on Sep 16th, 2011

Any experienced Dallas auto accident lawyer would be able to tell you plenty of stories about people who have been injured by negligent drivers during rush hour. Even though there is no excuse for negligent driving, a Dallas car wreck attorney might also tell you that it is in your best interest to keep an eye out for these drivers, whether they are trampling on your rights or not

Threats

Many of the lawsuits that car accident lawyers file, unfortunately, are for wrongful deaths. This should give you an idea of how seriously you need to take bad drivers. In the best case scenario, you would end up winning a lawsuit in getting compensation for the pain, suffering and property damage that these drivers caused. Keep in mind that, in that scenario, you are still going through the trauma of an injury, the loss of property and the tremendous financial burdens that these drivers end up causing people. To put it mildly, a traffic accident never turns out well for anybody involved.

Getting Insurance After The Fact

Submitted by jrlaw on Sep 16th, 2011

Once you've been in a car wreck, the insurance companies are going to go out of their way to make getting insurance more expensive for you. There will also be a lot of them that will start offering you discounted insurance policies. You have to be careful with your insurance coverage after you've been in an accident. You may find that you end up giving up vital forms of coverage just to save a buck or two.

Compare Rates

Make sure you call around and ask about new rates if your present carrier jacks yours up after a wreck. When you're doing so, be sure that you contact good insurance providers, not discount ones, first.
It's not a bad idea to call in and talk to a human being rather than using one of the online rate quote pages. Oftentimes, the salespeople you talk to online can offer you special deals that you might not find on the online version, which makes it worth it to talk to them instead of just using the Internet site.

Coverage Types

Your coverage has to be good to make your insurance worth it. Be sure that you're not giving up the kinds of coverage you need to keep your property safe and to make sure you have enough money to pay for medical expenses and other potential problems that result from accidents.

Auto and Autumn: Tips on Driving This Fall

Submitted by jrlaw on Sep 16th, 2011
Autumn is really one of the best times of year for driving. To begin with, the weather is cooled off enough that it's a lot nicer to be on the road. It's also the end of the summer tourist season, so there tend to be fewer drivers on the road who are lost or confused in just about every major city. There are some things you'll want to be sure you keep in mind, however.

The Light

If you're a morning and afternoon commuter, you're going to start having light in your eyes at some point during your commute in the autumn. This will mean that your visibility will be seriously impaired. The worst thing about this situation is that sunglasses actually make it worse for some drivers and that, if you have a dirty windshield, you'll oftentimes end up with so much glare that you cannot see at all.
Obviously, there isn't much that you can do about the sun, so you have to accommodate these changes in lighting where you can. Make sure that your windshield is always cleaned off so that you don't end up blinded when light hits dirt or other debris. You may also want to experiment a little bit to see whether wearing sunglasses during these times of day and evening helps you or hinders you in terms of improving your visibility.

The Severity of Being Rear-Ended

Submitted by jrlaw on Aug 31st, 2011

Accidents that involve drivers being rear-ended are among the most dangerous accidents to occur. There are some signature injuries that these accidents cause, and it's a good idea to visit a doctor if you have been involved in such an accident (just in case). Even if you do not feel pain or discomfort at first it does not mean that you haven't been injured. Some of these injuries take a while to manifest.

One of the classic injuries that frequently results from rear end crashes is “whiplash”. Whiplash develops when the victim's head snaps back and forth very quickly causing trauma to the spine and the muscles around it. This injury can be very serious and, unfortunately, it can take a long time before it even becomes apparent. This is the reason you need to visit a doctor if you have been in one of these type wrecks
.
One of the reasons that rear end accidents end up injuring people quite frequently is because people simply do not see it coming. In a lot of instances they're not ready for the impact, and when it hits they end up being hurt a worse because of that. Of course, it's much harder to avoid being in a rear end accident because of this as well.

Big Rigs Big Problems

Submitted by jrlaw on Aug 29th, 2011

It's easy enough to deal with big rigs when they're on the Interstates around Dallas, but it gets harder when they're driving around the city. This is when their size becomes a significant hindrance and when you really have to make sure that you're watching out for them. Here are some things to watch out for.

Don't Stay Alongside Them

It's usually best if you can either stay a safe distance behind a semi or get ahead of them quickly. Driving alongside them is a particularly dangerous thing to do. Their tires tend to kick up debris from the road and, if one of those tires happens to blow, it can create an obstruction very quickly. The draft alongside a semi is dangerous to motorcyclists and bicyclists.

Watch for Them Backing Out

Semi drivers cannot avoid taking up both sides of the road when they're backing up into or out of driveways in some cases. If you see them in a position where they're crawling across the road, slow down and plan on waiting a minute for them to finish what they're doing. It's frustrating sometimes, but it's the only way that they can get into some driveways and loading bays and they don’t have much of a choice.

Cure For The Common Car Crash

Submitted by jrlaw on Aug 29th, 2011
Some of the most common types of car wrecks can be avoided without having to pay a lot of money to modify your vehicle to do it. Some vehicles also come with features that you may want to look for if you're buying a new vehicle that can help you avoid being involved in an accident.

Sideswipes

Being sideswiped is one of the most common types of accidents. These usually occur when somebody is driving in another driver's blind spot in the driver tries to move over into the lane without checking by turning their head. One of things you can do to avoid these kinds of wrecks is to purchase a blind spot mirror. These are small mirrors that attach to your side mirrors that give you a better view of the lane next to you. Remember, however, that you always need to check with your head before you change lanes. Having a blind spot mirror just gives you a way to confirm what you see when you check by turning your head.
