How to Appeal A Denied Social Security Disability Claim
If you wish to file an appeal, you or your representative must make a request for an appeal in writing within sixty days from the date that the negative decision letter is received. The SSA assumes you received the letter five days after the date on it, unless you or your representative can prove you received it later.
Levels of Appeal
The SSA provides for three levels of appeal. The first level is a hearing by an administrative law judge, the second, a review by the appeals council, and the third level of appeal consists of a federal court review.
