Study: Drivers Know the Risks, But Continue to Text While Driving

Submitted by jrlaw on Nov 24th, 2014

Texting and driving continues to be a problem, and according to a recent survey sponsored by AT&T, nearly all of those who admit to texting while driving admit they know the dangers. Unfortunately, many of these same people also believe that "nothing will happen to me" while behind the wheel of a car.

Survey Overview

Text and Drive Survey by AT&TThe survey of drivers who admit to texting and driving daily produced alarming results. For instance, 98 percent of those in the survey who admitted to texting daily stated they were aware of its dangers. In spite of this knowledge 75 percent of them admitted they engaged in texting while they were driving in spite of the fact the practice is against the law in some states. Even more alarming is the fact that two-thirds said they read text messages while they were stopped at either a traffic signal or stop sign and more than a third admitted they sent text while the car was in motion.

AT&T released the survey during the first week of November as part of a projected campaign against texting and driving, or (more likely) as a campaign for their new DriveMode app which automatically silences text message alerts when a person is moving at least 15 miles per hour.

Injuries Caused by Defective Construction Equipment

Construction workers in Texas put their trust in the equipment they use on sites to work properly so that they can complete their work in a hassle-free, injury-free manner. Most of the time, this equipment is large and can contain many moving parts. Because of this, any injuries caused by malfunctioning construction equipment can be catastrophic and life changing.

There are many reasons why construction accidents occur, with defective equipment being one of them. These defects may have occurred while the equipment was being manufactured, or could have arose due to lack of regular required maintenance.

Here are a few examples where defective construction equipment can cause a serious accident:

New Distracted Driving Study Targets Trauma Surgeons

Submitted by jrlaw on Nov 3rd, 2014

Distracted Driving Study in ArizonaDistracted driving is a common cause of car accidents on our roads today.  In 2012, about 421,000 individuals were injured as a result of distracted driving, while 3,328 were killed. This is a number that’s set to increase due to the lack of information on how dangerous this practice really is.

A recent intervention targeting physicians at the University of Arizona set out to sensitize workers on the impact distracted driving has on them was carried out by researchers looking to raise awareness on the use of communication devices such as cell phones.

Three-Part Research

The research was carried out in three parts; the first part involved researchers stationing themselves outside the university’s parking lot in order to observe driver behavior as they pulled out of the hospital. They observed activities such as talking on the phone or texting. Staff members had their identities verified thanks to their hospital passes, badges or scrubs. Incidences of distracted driving were recorded in three intervals over the duration of a week.

Crane Accidents

Texas Cran Accident Injury AttorneyCrane accidents in Texas are serious incidents usually occurring in or near constructions sites. The majority of crane accidents occur as the result of a succession of unfortunate events, so filing an accurate claim against the correct parties can be a complex task.

Causes and Prevention

There are many events that may come into the picture to cause a crane collapse or another type of crane-related accident. Some of those events include but are not limited to:

  • Operator error
  • Oversight
  • Mechanical issues
  • Bad luck (yes, this is also a possibility though probably more remote than the others)

It is possible to prevent crane accidents if everyone makes safety a priority. It’s important for employers and workers to engage in effective safety measures throughout every aspect of the job. If an employer fails to properly train a worker, the employer could be found liable for a resulting accident.

Crane Accident Causes and Statistics

According to OSHA, the leading causes of crane accidents are:

Texas Rental Car Accident Lawyer

Have you been injured in an auto accident involving a rental car?

Rental Car Crash LawyerRenting a car is something that most people don’t do on a regular basis. People drive rental cars in areas that are not entirely familiar to them. It’s not surprising that drivers of rental cars are often involved in car accidents due to the unfamiliarity with their environment - as well as with the car.

Rental companies are required by law to ensure that their cars are in good condition before renting them out to the public. This could mean determining whether the brakes, lights and other parts of the vehicle work as they should and that the vehicle has been adequately serviced to ensure that it can go for many miles without breaking down or causing an accident due to faulty components.

The Rental Company May Have Limited Liability

It’s important to note that the rental company is not necessarily responsible for accidents that occur once the vehicle is out of their hands. Customers are supposed to have insurance coverage - either a liability or comprehensive policy. The only real exception here would be when the rental company negligently rents a vehicle to someone who clearly poses a risk to others, or should have not been allowed to rent a car in the first place.

Grease Gun Injury Lawyer

Submitted by jrlaw on Oct 20th, 2014

Grease guns are special tools used in certain industries to deliver grease to moving parts. They typically have a disposable grease cartridge; however, it’s not uncommon for these devices to be filled manually as well. Grease guns may be operated manually or electrically, and may be lever-operated, pneumatic, battery operated or trigger operated.

Grease Gun Accidents

Grease Gun Injection Injury LawsuitBecause of the high pressure that’s needed to deliver grease to the appropriate parts, the possibility of getting injured is present, and such an injury can have devistation results. Injuries typically affect the non-dominant hand, but can affect whole limbs, the abdomen, and more.

Most individuals who sustain these kinds of injuries are (generally) males working in an industry setting. Some victims have been known to initially ignore their injuries, passing them off an inconsequential. With time though, these injuries can develop into severe swellings affecting the whole limb. In addition, some people also develop burns because of the composition of the grease. It’s estimated that 30 to 40 percent of grease gun injuries end up in amputation of whole limbs if the victim doesn’t seek treatment in a timely manner.

Indiana Daycare Employee Charged With Sexual Abuse

Submitted by jrlaw on Oct 13th, 2014

A child care employee at an Indiana daycare facility is facing charges after sexually abusing a child under his care. Ali Al-Awadi was arrested in August after he allegedly fondled a four-year-old child at The Children’s Choice Learning Center in Indiana.

Children's Choice Daycare in IndianaWhile he initially denied the allegations, the injuries inflicted on the victim’s body confirmed the accusations. The daycare is now faced with several violations, with one of these being not notifying the victim’s parents when they found out about the abuse.

The state’s Family and Social Service Administration notified the daycare via letter of their intention to close down the facility by withdrawing its license. However, the daycare has 28 days to appeal this decision.

A History Of Violating Rules

The Children’s Choice Learning Center has in the past allegedly flouted several laws such as not checking the criminal records of two of their employees as well as retaining one of the caregivers who was disqualified from working in the facility a few years back.

The firm that oversees the daycare issued a statement stating that they were working on a corrective plan to ensure that the center is full compliance to restore their license.

Fracking Leads to Increase in Serious Truck Accidents

Submitted by jrlaw on Oct 8th, 2014

A rise in fracking has subsequently given rise to the number of car accidents in many communities. Why?

Fracking Truck Accident LawyerOver the last 4 years, there has been an uptick in the number of car accidents involving three or more vehicles on Texas roads. In April of this year, a woman was killed when an 18-wheeler ran a red light and smashed into the side of her car. The 18-wheeler was returning to a fracking site at the time of the accident. Studies have shown that the fracking boom in Texas is tied to the number of commercial vehicle accidents happening all over the state, posing questions about this industry’s greater impact.

Vilma Marenco, the victim in this accident, was hit by a truck hauling pipe which had no insurance and who's driver carried no commercial drivers license. It was also later determined that the driver was hired before being subjected to extensive background and drug tests, and that the company which owned the truck had failed a DPS audit the previous year. Additionally, the company’s drivers had been ticketed numerous times for safety and transport violations.

Shattering Shower Doors & Product Liability Lawsuits

Submitted by jrlaw on Sep 29th, 2014

There are many different types of product liability cases, but one of the most unusual and increasingly problematic areas is that of exploding shower doors. This problem is occurring with more frequency not just the state of Texas, but throughout the entire United States.

The Recent Growing Trend

Exploding Glass Shower DoorThe problem of an exploding shower stall can be quite dangerous as in the case of a 12-year-old Dallas boy who was injured in such an event. The boy had just stepped into the shower, and the water was running when his mother heard an explosion and screaming from downstairs. When she ran upstairs, she found his bathroom covered in tiny pieces of glass—it was impossible to even see the floor. Her son was standing on top of a corner shower shelf screaming. The child told his mother there was an explosive shattering noise as the whole door crashed.
