Residents’ Rights Week October 4-10

Submitted by jrlaw on Oct 5th, 2009

Residents’ Rights are a provision of the regulations under the Nursing Home Reform Act of 1987. The regulation states that a nursing facility must protect and promote the rights of the residents. Residents and families must be informed, orally and in a language they understand, of the rights and regulations that govern nursing homes.
Residents’ Rights:

  • To choose their doctor and pharmacy
  • To choose their roommate
  • To be informed on services provided
  • To voice grievances and complaints without retaliation
  • To review and/or obtain copies of medical records
  • To inspect state survey reports
  • To be represented by family councils organized by families and friends
  • To be informed about the admission policy, extra expenses, and provisions for the protection of residents’ funds
  • To be informed of their rights regarding transfer and discharge in a Medicaid facility.

Family Councils commonly celebrate Residents’ Rights Week with special activities for residents. If you or someone you know has not been grated these rights, please contact our firm.
