Going After Abusive Nursing Homes

Going After Abusive Nursing Homes

Elderly people are not the only people who end up in nursing homes or other residential care facilities. In fact, people with mental illnesses and other severe conditions that make it impossible for them to care for themselves oftentimes end up in these facilities. Sometimes, these facilities end up doing far more harm than good. A facility in Texas, for example, was recently implicated in the death of a mentally ill teenager. That teenager – for $650 per day – had a room in a trailer house with six other patients.

Some of these nursing home facilities end up getting away with abusing and even taking the lives of many patients before they are finally stopped. One of the things that families can do to remedy the situation is sue. Suing a nursing home is a complex undertaking but, with the right legal representation, you can maximize your chances of success and, perhaps, get compensation for what you have been put through.

How it Works

The attorney you hire will try to determine where the nursing home or other healthcare facility was negligent in giving care. When they make this determination, it gives them an opportunity to assess how much in damages was the direct result of that negligence and to go after the nursing home provider in court.

Your attorney will also take care of any additional investigation that needs to be done. Quite often, there are accompanying criminal charges that go along with nursing home abuse and neglect cases. These do not mean that you cannot sue. The criminal investigations, however, are not undertaken to determine whether or not the nursing home has a financial obligation to anybody, so you will have to speak to your attorney about making that determination.

Your loved one does not have to be elderly to be the victim of nursing home abuse. In any long-term residential care facility, there is an opportunity for abusers to take advantage of people and to commit horrific acts of abuse. Fighting back oftentimes means getting the right attorney to represent you.

Many attorneys will take these claims on a contingency basis, which means that you don't have to pay legal fees up front. Under such an agreement, you can use the services of a top-notch attorney to pursue your claim without having to worry about the money unless you happen to win compensation from a jury award or a settlement.
