Are Product Liability Claims Worth It

Product liability claims are likely more common than you think. For instance, according to the US Consumer Products Safety Commission, some types of product liability claims have increased in number over the years.

Toys

Toys are very common causes behind product liability claims. In 1997, according to the US CPSC, there were approximately 141,000 injuries that resulted from toys. By 2006, that number had increased to over 255,000 with increases every year during the time span measured.

Toys have the potential to cause devastating injuries. When they’re not labeled correctly as to the age groups that they’re appropriate for, for instance, they may end up causing serious injuries due to parts that are small enough to swallow, sharp edges or other hazards. When children are injured, parents sometimes contact product liability lawyers to pursue a case against the manufacturer or distributer for damages.

Consumer Products

Consumer products include a wide range of different products, of course, but there are some that are more dangerous than others when they’re designed or manufactured defectively. Cribs and bedding, for instance, are blamed for approximately 26 deaths yearly, according to CDC numbers. Electronics can also be dangerous. The batteries in laptop computers have been recent subjects of recalls because of the danger of fire that they pose and, in some cases, because they simply overheat.

Understanding Product Liability

Product liability law covers the design, manufacture and advertising of a product. If any of those three are found to be defective, it may be possible to get a jury award or a settlement that will cover your losses from the product and help to pay for any injuries you may have suffered due to the products.

Not every one of these claims is going to be a particularly large one, of course. Sometimes, people are only put out for a small amount of money by a defective product and that may not warranted filing a lawsuit. There are claims, however, that are for very large amounts of money but, unfortunately, that usually means that someone suffered a great deal of property loss or serious injuries—and even death—due to a defective product.
